April 2003, Carlsbad, CA, USA - ROMER, Inc. and Corp. announced that they have reached a final settlement with FARO Technologies, Inc. in the patent lawsuit pending in the Federal District Court for the Middle District of Florida, and that the case has been dismissed with prejudice. Under the terms of the settlement, FARO cannot reassert the patents-in-suit against any of ROMER and ’s current products, nor can FARO bring a suit against ROMER and ’s 3000iSC seven axes scanning arm on any patent currently held, or obtained by FARO in the future. FARO filed the lawsuit in January 2002. ROMER and subsequently filed counterclaims that the patents were not infringed, are invalid, and are unenforceable due to FARO’s inequitable conduct before the United States Patent and Trademark Office while obtaining the patents.
Commenting on the settlement Homer Eaton said, “We are pleased by the outcome of this case. That combination is proving to be an especially effective solution for laser scanning applications.”
